How Will Property Be Divided in Your Missouri Divorce?

Missouri is an equitable division state. This means that in your divorce, the court will divide marital property equitably. This may not be a 50-50 split of property. Instead, the court will look at what is fair and equitable given your specific situation. For example, marital misconduct is a factor that can be considered in dividing property, especially if one spouse has done something to dissipate or waste any marital assets.

The first step in this division is to determine which assets and debts are marital. Marital property is any asset or debt acquired during your marriage. This includes:
